Ohio Department of Education Public Hearing on Special Education Policies and Procedures (Revision to Rule)
On November 16, 2009, the Ohio Department of Education, Office for Exceptional Children, will hold a public hearing on the revision of one of the rules that is part of the Operating Standards for Ohio Educational Agencies Serving Children with Disabilities, Ohio Administrative Code 3301-51-05. This change is being made to reflect changes made to a federal regulation regarding a parent's ability to revoke consent for special education and related services, 34 Code of Federal Regulations (CFR) Section 300.300. The hearing is held pursuant to 34 CFR Sections 300.165 and 300.509. The rule is 3301-51-05 Procedural Safeguards

The public hearing will be held from 1:30 to 3:30 p.m. on Monday, November 16th, 2009, Dublin Metropolitan Library, 75 North High Street, Dublin, OH 43017.

INFORMATION ALERT: PROPOSED RULE CHANGE TO MEDICAID DENTAL BENEFITS
BACKGROUND: The Ohio Department of Jobs and Family Services (ODJFS) is required by the state operating budget to reduce the Medicaid reimbursement rate for optional Medicaid services. The budget required ODJFS to achieve at least 3 percent in savings for these services. In Ohio dental benefits are an optional Medicaid service. Rules being proposed by ODJFS would reduce the number of exams and cleanings per year to one each.
The Ohio Department of Jobs and Family Services is proposing a series of rules to reduce the Medicaid reimbursement rate for optional Medicaid services. For some services such as adult dental, ODJFS has proposed to reduce the benefit provided rather than the reimbursement rate.
If approved, adults who receive Medicaid dental benefits would experience a change in the number of exams and cleanings they are eligible to receive in a calendar year. Currently, Medicaid provides adults with two exams and two cleanings per year.
Listed below are arguments in favor of the rule change and arguments against the rule change.
FAVOR:
It is reported by the Ohio Department of Health that oral health care is the number one unmet health care need in Ohio. In some areas of Ohio, dental health professionals will not accept any patients who have Medicaid dental coverage. As a result, oral health care services are not provided or are difficult to obtain.
It is widely believed that dental services are difficult to obtain because the Medicaid reimbursement rate for dental services is too low. The Ohio Dental Association continues to support a Medicaid reimbursement rate that is higher to encourage more dentists to participate in providing services.
The Ohio Department of Jobs and Family Services considered this information when deciding to reduce the number of exams and cleanings from twice per year to once per year. It was considered by ODJFS that reducing this particular benefit in this way would ensure that providers who do participate would continue to do so. It is believed that reducing the reimbursement rate for dental health care services would result in fewer providers participating in the Medicaid program. As a result, the dental health care benefit through Medicaid would be lost in many areas of the state.
While two exams and two cleanings may be a preferred health strategy, it is believed that one exam and one cleaning per year is sufficient to ensure good oral health for adults on Medicaid. The proposed rule change would continue dental health care benefits, just not at a level that has been seen in recent years.
OPPOSED:
The Ohio Department of Jobs and Family Services should not be proposing a decrease in benefits for adults covered by Medicaid. Instead, ODJFS should follow the language contained in the budget, which states ODJFS, “shall amend rules….as necessary to reduce…the Medicaid reimbursement rates {emphasis added}…to rates that result in an amount that is at least three percent lower than the amount resulting from the rates in effect on December 21, 2009.”
In previous budgets, the number of exams and cleanings was reduced to save the state money. However, in 2007, the state increased the number of exams and cleanings as well as the Medicaid reimbursement rate for those services (by 2 percent). This proposal unfairly reduces the benefit again while the increased rate remains.
A reduction in the number of exams and cleanings could lead to greater risk of periodontal disease (gingivitis), which some studies have indicated could lead to other health risks.
In the Burden of Oral Disease IV, the US Centers for Disease Control states that tooth decay and cavities for people with disabilities is much higher than for those of the general population. The report also states, “No national studies have been conducted to determine the prevalence of oral and craniofacial diseases among the various populations with disabilities. Several smaller-scale studies show that the population with intellectual disability or other develop-mental disabilities has significantly higher rates of poor oral hygiene and needs for periodontal disease treatment {emphasis added} than the general population, due, in part, to limitations in individual understanding of and physical ability to perform personal prevention practices or to obtain needed services.”
For Medicaid-eligible adults with chronic health conditions, poor dental care can result in systemic infections. The costs of treating a system infection by accessing care through a physician’s office or hospital far outweigh the costs of preventing it by providing needed exams and cleanings.

Upcoming IACC Full Committee Meeting - November 10, 2009
The Interagency Autism Coordinating Committee (IACC) will be holding a Full Committee Meeting on Tuesday, November 10, 2009 from 9:00 AM – 5:00 PM ET at the National Institute of Mental Health (NIMH), Neuroscience Center, 6001 Executive Boulevard, in Rockville, MD.
The agenda for the meeting will include a discussion of recommendations for the annual update of the IACC Strategic Plan for Autism Spectrum Disorder Research.

Workshop
Description: Students on the autism spectrum often present with
difficulty regulating their feelings and interacting socially. This
workshop describes how to handle meltdowns and design effective
behavior plans to prevent these moments and reduce frustration and
anxiety. The second part of the presentation details strategies to
motivate students to learn, ways to teach social skills, how to
generalize skills into the natural setting and increase acceptance and
tolerance from peers. Information will be imparted though lecture,
interactive exercises, and video clips.

Information: Jed Baker, Ph.D. is the director of the Social Skills
Training Project, a private organization serving individuals with
autism and social communication problems. He also directs social
skills training for Millburn Public Schools in New Jersey. He is on
the professional advisory board of Autism Today, ASPEN, ANSWER, YAI,
the Kelberman Center and several other autism organizations. In
addition, he writes, lectures, and provides training internationally on
the topic of social skills training and managing challenging
behaviors. He is an award winning author of five books, including
Social Skills Training for Children and Adolescents with Asperger
Syndrome and Social Communication Problems; Preparing for Life: The
Complete Handbook for the Transition to Adulthood for Those with Autism

sisters to obtain peer support and education within a recreational
context. It is a chance for siblings to meet other siblings who have a

Sibshop model intersperses information and discussion activities with
new games (designed to be unique, off-beat, and appealing to a wide
ability range), cooking activities, and special guests. We start each
session by making lunch together (menu decided by the group the
previous session.)
Public teacher Lou Curcio, meets the first Saturday of each month
(except in November when it will meet the second Saturday) from 12 - 3
pm at the Grace United Methodist Church, 601 East Boundary Street,
Perrysburg, OH through the school year. There is a fee of $25 for this

Linell Weinberg is the director of the Autism Society of Northwest Ohio (ASNO). She holds a Masters Degree in
Social Work from the University of Michigan. Along with managing the agency, Linell provides information and referral,
Individual Education Plan (IEP) assistance to families, plans educational programs and family fun events, runs support
groups, makes presentations about autism, and serves on various community-wide committees such as the Lucas County
Board of DD Best Practices committee. In 2005 she received a Community Hero Award in the Community Service category
from Big Brothers Big Sisters for her work with families affected by autism. Linell is inspired by her adult daughter with
Asperger Syndrome.

Sandy Brickner began her career as an Early Childhood Educator. Special Education became an area of focus,
serving families for 6 years as a parent mentor of 7 school districts for the North Central Ohio Educational Service Center.
Sandy joined the staff of the Ohio Coalition for the Education of Children with Disabilities in 2000.
She is currently serving families and professionals providing advocacy and training opportunities
related to the special education process. Sandy is also the western Ohio coordinator and lead
trainer for the “It’s My Turn” transition training for students age 14-21 and has provided training in
various school districts across Ohio.

implementation of transition planning in a good IEP. Discussion will include examples,

Chris Filler Transition Coordinator, Ohio Center for Autism and Low Incidence. A registered nurse and the Transition
Coordinator for the Ohio Center for Autism and Low Incidence (OCALI). Chris has worked with individuals with autism
and developmental disabilities and their families for over 20 years. She has served as an Early Intervention Service
Coordinator, Family Resource Specialist, Autism/Behavior Consultant for Lincoln Way Special Education Center and as a
private consultant for many school districts throughout the state of Ohio. She is also a past president of the Autism
Society of Ohio. Chris has presented for State and National conferences in the area of autism spectrum disorders,
behavior supports, sensory processing supports, transition to adulthood and parent-professional collaboration. Chris now
works for the Ohio Center for Autism and Low Incidence as the Transition Coordinator where her efforts are towards the
development of supports and resources for students with autism spectrum disorders and low incidence disabilities that
are transitioning to the adult world. She is involved with efforts to coordinate the systems of adult service agencies to
improve delivery of service for adults with disabilities. Chris has two children, one of which is an adult with autism.

presented a series of lectures on The Rule of Law in Theory and in Practice in the United

country. Judge Abood has a brother with developmental disabilities and currently serves on
The Arc of Lucas County Board of Directors.

Article: Educators developing strategies for teaching students with autism
Some educators who are faced with increasing numbers of students with autism in special-education and general-education classrooms say using assistive technology that reinforces visual -- rather than verbal -- skills and ties visual cues to the written word may be helpful. Other strategies districts should consider include better training for non-special-education teachers, access to evidence-based resources, support teams and partnerships between schools and parents.

Emergency Information Forms for Children with Special Needs
The American College of Emergency Physicians and the American Academy of Pediatrics are pleased to present the Emergency Information Form (EIF).
Emergency Information Form imageThis important document will assure prompt and appropriate care for Children with Special Health Care Needs (CSHCN). Now, when these patients present to emergency departments or health care professionals with an acute illness or injury, physicians, parents, EMS professionals, and nurses will be able to use the EIF as a tool to transfer critical information.
The EIF will ensure that a child's complicated medical history is concisely summarized and available when it is needed most - when the child presents with an acute health problem at a time when neither parent nor pediatrician is immediately available.
